Short summer leases and Delaware law

Delaware's Residential Landlord-Tenant Code says it is not intended to govern a nonrenewable rental agreement of 120 days or less in a calendar year for a home in Baltimore, Broadkill, Lewes-Rehoboth, Indian River or Cedar Creek Hundred, unless the agreement was made only to avoid the Code. A 2025 Town ordinance describes one parcel in the Town of Ocean View as lying in Baltimore Hundred.

A lease that meets every condition of Section 5102(4) is not intended to be governed by that Code. Before signing one, read the written agreement for who handles pests and trash, and if it is silent, ask the owner or manager to put the answer in writing.

The code also makes the owner of any residential rental provide adequate waste and recycling services. That rule is Section 93-15F(5). Guests should ask the owner or manager where trash goes and when it is collected.

  • Ask the Town before work starts. Section 84-4E(1) of the Town Code calls for a building permit before repairs to a building, including normal maintenance above a set cost, and the code does not say whether rodent sealing counts. Put the question to the Planning and Development Division, and ask the pro whether the quote assumes a permit.
